Abstract

The Charter of Medina (Mīthāq al-Madīnah) represents the first written constitution in human history that laid down foundational principles for governance, social justice, and peaceful coexistence in a pluralistic society. Under the leadership of the Prophet Muhammad ﷺ, this charter united diverse religious and tribal communities—Muslims, Jews, and others—into a single political entity governed by mutual rights, responsibilities, and respect. It established the concepts of citizenship, social welfare, and rule of law, ensuring protection of life, property, and faith for all members of society. This paper analytically examines the distinctive constitutional features of the Charter, including the recognition of communal autonomy, fair distribution of power, and the integration of moral and legal principles into governance. The study highlights how the Charter institutionalized justice, equality, and religious freedom, while rejecting tribal discrimination and promoting consultation (shūrā) as a basis for political decision-making. Moreover, it safeguarded the rights of minorities and emphasized ethical values such as honesty, loyalty, and social cooperation. The analysis further explores debates around the term “Ummah” within the Charter, as discussed by classical scholars and Orientalists, showing how its use reflected a new inclusive political identity rather than a purely religious one. The Charter thus emerges as a universal model of constitutionalism, embodying values of democracy, human dignity, and interfaith harmony, which remain relevant to modern states and global peacebuilding today.
