Abstract

This research article examines the historical trajectory and contemporary resurgence of jtihad (independent juristic reasoning) in Islamic law. Through analysis of classical formulations, historical transformations, and modern applications, the study challenges the narrative of complete juristic stagnation following the alleged "closing of the gates of Ijtihad." Instead, it demonstrates how Ijtihad has continuously evolved, adapting to changing socio-political contexts while maintaining methodological continuity with Islamic legal tradition. The article particularly focuses on 20th and 21st century revivals, analyzing institutional innovations like collective Ijtihad and examining contemporary applications in gender jurisprudence, bioethics, and Islamic finance. Findings reveal that Ijtihad remains a vital mechanism for Islamic legal dynamism, though its practice faces significant challenges from political pressures, traditionalist resistance, and epistemological debates about legitimate methodology.
